The situation on the ground is this:
L-1 extensions for software related jobs are pretty much now dead. TCS, IBM, etc., are getting denied. USCIS has changed their definition of "specialized knowledge". Now, "specialized knowledge"means no on in USA has that knowledge and cannot obtain that knowledge through training.
Staffing companies; small companies or companies who are h-1b dependent (larger comapnies) are stuck in Vermont Service Center. There are some that aren't having problems but usually it starts with one case stuck in background check; followed by a few approvals; then another one stuck in background check and then all of a sudden all cases are stuck in background check. The scrutiny uscis is giving these types of cases is tremondous and they are denying all of them. Right now; if you monitor the forums you are starting to see the denials. However, vermont service center was sticking cases in background check since fall of 2007. Now; those cases are being worked on and denied. We are just at the beginning of this.
Traditioinal American companies; h-1b and greencard have become toxic and political. Many of them aren't filing greencards for people due to layoffs or too many poeple responding to the advertisements. I haven't seen h-1b issues with them yet. However, if they are not going to do GC then what is the point.
Staffing companies had easiest time filing labors becuse they don't layoff people. However, after Iowa issue now they have started cancelling h-1b's for people on bench, etc. There are so many transfer requests in open market right now; but companies aren't filing because they are getting rid of their own people and it would be foolish to bring on more people in non productive status. I do know of one person working at FEDEX as a permanent employee (she has greencard); she told me that FEDEX has taken the detemination that they will not be filing greencards for anyone in the near future. Person can stay until duration of their h-1b but then that will be it.

I have long been of the opinion - told to me by an immigration lawyer, that when you file your I-485 when the PD is current, and your dependents file also that only the Primary counts towards the quota, dependent GC's do not count towards the employment based visa quota - so this may be a moot point as to whether or not they should be in the family or employment based lists.
Much like when you file for an H1B, the H4 for your dependants does not count agains the overall H quota.

I agree with you vin13, remove country quota or by number of years we are legally here in US.
Base on PD is not fare enough. Many of us filed GC vary late because of one or many reasons.

Another reason was IV was relying on skil bill but when point system is used Skil bill does not fit into it. They threw it away. Also skil bill was asking exemptions for MS and STEM apart from increase in numbers(Congress never gave exemption from Cap except spouses of citizens). It might be better with just giving numbers so that only one provision was there. I think now IV is asking only numbers of green card and this campaign has better chance of success(atleast some increase in numbers). But if we focus multiple things(Involving in H1b issues and other smaller issues) at the same time then it may be tough to achieve.

The reality is that this, as usual, is primarily driven by business needs. Major employers such as Bill Gates lobby mainly for H1B numbers increase. Employers are very much aware that H1B staff under pressure can put up and deliver the very long journey of 60-80h/week expected at Microsoft. Yes, Microsoft and many other major employers could easily find qualified US students with two years of experience, skills by the way comparable to what the vast majorities of H1B's offer, but Americans who do not need the H1B would give a finger to any employer who would expect that an American would work 80h/week for 55K/year.
The illegal aliens are being backed by major employers of cheap labor, such as Wall Mart and many others. Illegals also can put extra long hours and therefore they yield more output for less investiment. That's is the reason that US employers seem to fight so consistently to keep them here.
I estimate that immigrationvoice.org efforts do not count for 0.5% of the final result of this bill. As a matter of fact, chances are more we fight and protest, more people will be outrageous and scared and will call *their* congressmen even harder in order to push us out.
For the naive and dreamers out there who are shaking their heads after reading the above and believe that employers cannot find qualified applicants, so just answer this:
How many million dollars per year are the top management of Fortune 500 companies making? The US is not about drastic wages inequalities. This is about paying a fair salary, otherwise we have increasing salary inequality and this should be renamed then to Mexico, India or something like that.

I pledged 100 $ today for Aman's expenses because I felt really bad abt that. I donated around 300$ till date including 20$ recurring contribution.
I filed my 485 long time ago. But when people who are really seeing the fruits of IV (July VB reversal) are higly reluctant to donate even a few bucks, while they are spending thousand's of dollars for their 485 stuff, I am kinda confused.
Are people really that selfish not to donate a few bucks(may be 5$per month) to an organization which is making them file 485 and reversed all this fiasco.

Important thing that needs to be changed from USCIS side is for EB GC applicants who get their 140 approval and waiting to file 485 from certain time period like two yrs or more USCIS should allow them to file for 485 irrespective of the current rule 'PD has to be current to file for AOS'.
Otherwise it's a clear loop whole in the EB process..People can't wait that much long to file for AOS for changing business trends or in this economic downturn (which force them to change of job).. USCIS does not loose anything in that case and can make more money if the applicant resumes the process with different employer. Biggest mistake was made by USCIS in July 07 by allowing everybody to file for 485 with out caring people who were sincerely waiting in the line and who were waiting for PERM approvals in full time positions unlike most of Desi consulting based GC applicants ( who used substituted labor by paying 1000s of dollars to their body shopping based companies who misuses the system always) . DOL and USCIS should examine and punish each applicant of substituted labor (who got their GC in 2 to 3 yrs time period through desi body shopping companies).
Sufferers of the existing system are EB2-I,EB2-C, EB3-C and EB3-I GC folks (Indian and chinese applicants). Existing system neglects EB3 folks.. it's gonna take 10yrs for them to wait and apply for 485 as per Today's date. :mad::mad::mad:

Now for the bad news, defending this agreement could cost much more than $10,000, besides time and hassles. More so, if employee and employer are in two different states as employer can file suit in their state. In short, $10,000 is cost of moving out of this job at the time of your choice. You could also look at it as the added cost of GC.
I suggest you should consider making a plan to move in your life and career. As they say, freedom is priceless.

Incidentally, there was a townhall meeting with Senator Bob Casey in Pittsburgh. Thankfully i got to speak with him and personally put forth our story of endless waits for a greencard. Am not sure if it will genrate any tangible action from his end, but it certainly drew attention of the public present there, his staff and mostly importantly the Senator's mindshare.

If you think it is that ridiculuous, then you should tell the core members that. They did ask us to call him on the last day of LD. There is nothing wrong in writing to him. In fact, you are making a comparison that is not correct.
Actually, it was an exceptional situation. As you are well aware of, we had to get an unanimous consent if the skil bill were to pass in the LD, so, we needed to have Session's approval. To deflect the situation, he just said that his office hadnt received any positive comments.. When we ended up jamming his phones and gave all the positive comments, what came out of that, nuthing.. he did not budge from his stance.. It was just a ploy and even if the entire US of A had called him, he would not have changed his stance.. He had to score brownie points from his supporters. He knows that the Skil bill will be passed next year, and may be some form of CIR even.. He can then blame it on the democrats and stand for re-election in 2009 with complete support from his supporters..
Its all a gimmick for votes. This is politics, same thing in every country, just more sophisticated here...
Actually, it was an exceptional situation. As you are well aware of, we had to get an unanimous consent if the skil bill were to pass in the LD, so, we needed to have Session's approval. To deflect the situation, he just said that his office hadnt received any positive comments.. When we ended up jamming his phones and gave all the positive comments, what came out of that, nuthing.. he did not budge from his stance.. I am in for $100.
By the way if we have 20,000 members and even if each pledge $5, we can reimburse the core team expenses. How often we have to teach and tell the Math to our so called highly skilled free riders.
Some should be feeling really guilty for using IV and not contributing till now. Come out the stingy attitude and help.
